Winning Divorce Strategies
Winning Divorce Strategy of the Day
Use Experts. In many divorce cases, the use of an expert can make or break your case. If your case involves complex financials, alimony, pensions plans, and support issues, it may be worth your time and money to employ a CPA to conduct an evaluation of the case, and testify in court on disputed issues. The choice of CPA is very important, becuase the CPA must have previously testified as an expert in court, and should have a resume outlining the court cases in which he or she previously testified, qualified as an expert, or was utilized as an expert. In cases where child custody (time sharing arrangement in Florida) is at issue, consider asking the court to order a custody study, sometimes called a home study. If the court has the resources, the court may provide a home study evaluator for minimal cost. A private home study conducted by a psychologist can cost upwards of $7,500.00 but may be money well spent if custody is hotly disputed. Other experts to consider are a real estate appraiser, and home inventory specialist. These experts should be told that they will be asked to testify in court, because their reports are hearsay unless presented with live testimony by the expert, in court. In addition, if the mental stability of one of the parties is in question, you can motion the court to order psychological evaluations of any party, however keep in mind this can get very expensive. If alimony is an issue in your case, you may want to retain an expert in the field of vocational rehabilitation, also known as a vocational expert. These experts will conduct an evaluation of the party seeking alimony, to determine whehter they have income earning potential and what income they could reasonably earn if they enter the work force.
